1. About Festillo — Platform Nature

Festillo ("the Platform," "we," "us," or "our") is an event planning coordination platform operating in Subedar Nagar, Bithoor, Kanpur, Uttar Pradesh. We facilitate connections between event clients ("Users," "you," or "Client") and independent third-party party lawns, venues, and service vendors ("Service Providers" or "Hosting Party Lawns").

Our role includes:

• Helping you discover and evaluate suitable venues and vendors
• Coordinating bookings and communications on your behalf
• Providing event planning advisory and management services
• Acting as a support intermediary throughout the event lifecycle

2. Services Offered

Festillo provides the following services:

2.1 Event Planning & Coordination

We offer end-to-end event planning services for weddings (including haldi, mehandi, sangeet, vidai ceremonies), anniversaries, birthday parties, baby showers, griha pravesh, and other social celebrations.

2.2 Venue Sourcing

We connect clients with our network of partner party lawns and banquet halls in Kanpur. Venue availability is subject to confirmation from the respective venue at the time of booking.

2.3 Vendor Coordination

We coordinate photography, catering, decoration, entertainment, and other services through our vetted vendor network. Each vendor operates independently and is responsible for the quality of their own service delivery.

2.4 On-the-Day Management

We provide an event manager to coordinate activities on the event day. This service is subject to availability and the specific package booked.

3. Booking & Payment Terms

3.1 Booking Confirmation

A booking is confirmed only upon receipt of the advance booking amount as specified in your booking agreement. Verbal confirmations or email enquiries do not constitute a confirmed booking.

3.2 Payment Schedule

• Booking Advance: 20–30% of total estimated cost (non-refundable in certain cases — see Cancellation Policy)
• Mid-Payment: As agreed in the booking contract, typically 30 days before the event
• Final Payment: Remaining balance due no later than 7 days before the event date

3.3 Pricing

All quoted prices are inclusive of Festillo's coordination fee. GST and applicable taxes will be charged as per government norms. Final pricing is subject to your specific requirements and confirmed in writing before payment.

3.4 Payment Methods

We accept bank transfers (NEFT/RTGS/IMPS), UPI, and cheques. All payments should be made to the official bank account or UPI ID provided in your booking confirmation. We are not responsible for payments made to unauthorized accounts.

4. Cancellation & Refund Policy

4.1 Cancellation by Client

• 90+ days before event: 80% of advance amount refunded
• 60–89 days before event: 50% of advance amount refunded
• 30–59 days before event: 25% of advance amount refunded
• Less than 30 days before event: No refund on advance amount

4.2 Cancellation by Festillo

In the rare case that we must cancel due to force majeure or unavailability, we will provide a full refund of amounts paid to us and assist you in finding an alternative arrangement.

4.3 Venue Cancellations

Refund terms for venue bookings are governed by the respective party lawn's own cancellation policy. Festillo will communicate these terms to you at the time of booking and will assist in recovering refundable amounts from the venue.

4.4 Refund Processing

Refunds are processed within 7–14 working days from the date of written cancellation request and approval.

5. Limitation of Liability

Festillo shall not be held liable for:

• Any failure, deficiency, or substandard service directly provided by a third-party venue or vendor
• Loss, damage, theft, or injury occurring on the premises of a partner party lawn
• Force majeure events including but not limited to natural disasters, government orders, riots, or power failures
• Delays, cancellations, or changes by third-party vendors beyond our control
• Any indirect, incidental, special, or consequential damages arising from use of our services
• Technical issues with third-party payment gateways or communication services

Our maximum liability to any client for any claim arising from our services shall not exceed the total amount paid to Festillo (excluding amounts paid directly to venues or vendors) for the specific booking in question.

6. Dispute Resolution

6.1 Disputes Between Client and Party Lawn / Vendors

Festillo shall not be a party to any dispute between users and partner party lawns or service vendors. While we will make reasonable efforts to assist in facilitating communication and resolution, the legal and financial responsibility for resolving such disputes lies with the parties directly involved — the client and the service provider.

6.2 Disputes with Festillo

Any dispute arising specifically from Festillo's coordination services should first be raised in writing to hello@festillo.in. We are committed to resolving such matters within 15 working days.

6.3 Mediation

If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation through a mutually agreed mediator before pursuing legal action.

6.4 Arbitration

Unresolved disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Subedar Nagar, Bithoor, Kanpur, Uttar Pradesh.

7. User Responsibilities

As a user of our platform, you agree to:

• Provide accurate and complete information at the time of enquiry and booking
• Make timely payments as per the agreed schedule
• Communicate changes to guest count, requirements, or event date promptly
• Comply with the rules and regulations of the booked party lawn or venue
• Treat our staff, partner venue staff, and vendors with respect
• Not engage in any illegal activity during events booked through our platform
• Ensure all invited guests comply with venue and local authority rules

8. Vendor & Venue Partner Terms

All party lawns and vendors in our network are independent contractors, not employees or agents of Festillo. Each partner has entered into a service agreement with us that includes quality standards and conduct guidelines. However, Festillo does not guarantee the performance of any third-party service provider beyond the facilitation and coordination services we provide.

9. Intellectual Property

All content on the Festillo website, including logos, images, text, and design elements, is the intellectual property of Festillo and may not be reproduced, distributed, or used without prior written consent. Event photographs taken by our partner photographers remain jointly owned by the photographer and the client, as agreed in the photography contract.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and other applicable legislation. Any legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts in Kanpur, Uttar Pradesh, India.

11. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. For bookings already confirmed at the time of a change, the terms at the time of booking shall govern unless you expressly agree to the new terms. Continued use of our services after changes constitutes acceptance.
